1. Acceptance of Terms
By accessing and using SoftswitchCRM ("the Service"), you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to abide by the above, please do not use this service.
2. Account Registration
To access certain features of SoftswitchCRM, you must register for an account. When creating your account, you must provide accurate and complete information.
You are solely responsible for the activity that occurs on your account, and you must keep your account password secure.
3. Privacy and Data Protection
We respect your privacy and are committed to protecting your personal data. Our Privacy Policy explains how we collect, use, and protect your information.
Customer and lead data is encrypted and stored securely. You retain ownership of all data entered into the system.
4. Payment Terms
SoftswitchCRM offers a freemium model with core CRM features at no cost. Additional features, higher usage limits, and enterprise capabilities may require a paid subscription.
All fees are billed in advance and are non-refundable. We reserve the right to change our pricing at any time with 30 days notice.
5. Embeddable Widget & Script Usage
You may embed the SoftswitchCRM lead capture widget on websites you own or are authorized to modify. You must not embed the widget on websites without proper authorization.
The embed script must not be modified, reverse-engineered, or used to collect data in violation of applicable privacy laws.
6. Prohibited Uses
You may not use SoftswitchCRM for any unlawful purpose or to solicit others to perform or participate in any unlawful acts.
- Violate any international, federal, provincial, or state regulations or laws
- Transmit or upload any material that contains viruses or malicious code
- Harass, abuse, or harm another person or organization
- Send unsolicited spam or bulk communications through our platform
- Scrape, crawl, or harvest data from other users without consent
7. Service Availability
We strive to maintain 99.9% uptime but cannot guarantee uninterrupted service. Scheduled maintenance will be announced in advance when possible.
We reserve the right to temporarily suspend service for maintenance, updates, or to address security concerns.
8. User Content & Data Ownership
You retain all rights to content and data you upload to SoftswitchCRM, including contacts, leads, and campaign content. By uploading content, you grant us a license to store, process, and display it as necessary to provide our services.
You are responsible for ensuring you have the necessary rights and consent to upload and manage any personal data through our platform.
9. Limitation of Liability
SoftswitchCRM and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the service.
Our total liability for any claim shall not exceed the amount paid by you for the service during the twelve months preceding the claim.
10. Account Termination
Either party may terminate this agreement at any time. Upon termination, your access to the service will cease immediately.
You may export your data before termination. We will retain your data for 30 days after termination before permanent deletion.
11. Service Modifications
We reserve the right to modify or discontinue the service at any time with reasonable notice to users.
Major changes to core functionality will be communicated at least 30 days in advance when possible.
12. Changes to Terms
We may update these Terms of Service from time to time. Users will be notified of significant changes via email or through the platform.
Continued use of the service after changes constitutes acceptance of the new terms.

14. Governing Law
These Terms shall be interpreted and governed by the laws of the jurisdiction where SoftSwitch LLC is incorporated, without regard to its conflict of law provisions. Any disputes will be resolved through binding arbitration or in the courts of competent jurisdiction.
